General Terms and Conditions (GTC)

1. Scope and Acceptance

1.1

These General Terms and Conditions ("GTC") govern all contracts between lorenzomasala.com ("LM") and its customers.

By placing an order, the customer acknowledges and accepts these GTC in their entirety.

1.2

Any terms and conditions submitted or referred to by the customer shall not apply unless expressly accepted by LM in writing.

Any conflicting or additional terms proposed by the customer are expressly rejected.

1.3

Any amendments or additions to these GTC are valid only if made in writing by LM.

1.4

By placing an order, the customer confirms that these GTC form an integral part of the contract.

1.5

Should any provision of these GTC be held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects its intended economic purpose.

 

2. Delivery

2.1 Delivery Charges

Deliveries within Switzerland are made by postal service.

A minimum shipping charge of CHF 6.00 applies.

Express delivery, special transport, and additional service charges are borne by the customer.

Shipping costs inside Europe are between 8 and 20 euros, VAT included.

Outside the EU, shipments are handled by DHL. If you prefer an alternative shipping method, please contact us by email.

Any additional costs will be covered by the customer.

Delivery time is usually within 14 working days. International deliveries may take longer.

Large orders may also require extended delivery time.

2.2 Partial Deliveries

Unless otherwise agreed, LM reserves the right to make complete or partial deliveries.

No additional shipping charges will be applied for partial deliveries initiated by LM.

2.3 Delivery Times

Delivery times are estimates only and are not binding.

Subject to product availability and unless otherwise agreed, orders are generally dispatched within 2–3 business days.

2.4 Express Delivery

If the customer requests express delivery, the applicable express shipping charges shall be invoiced to the customer.

2.5 Inspection upon Delivery

The customer must inspect the goods immediately upon receipt.

Any visible defects, shortages, or delivery errors must be reported in writing within five (5) days after delivery.

Failure to notify LM within this period shall constitute acceptance of the goods, without prejudice to any mandatory statutory rights.

2.6 Retention of Title

All delivered goods remain the property of LM until full payment of the invoice has been received.


 

3. Complaints and Returns

3.1 Complaints

Complaints concerning incorrect deliveries, damaged goods, or incorrect quantities must be submitted in writing.

Reeds and cane that have been further processed by the customer, or reeds that have been used beyond a brief testing period, cannot be accepted for complaint.

3.2 Time Limit

Complaints must be received by LM within five (5) days after receipt of the goods.

3.3 Required Information

Each complaint should include:

  • Delivery or invoice number

  • Article number

  • Quantity

  • Description of the defect or reason for the complaint

3.4 Resolution

Where appropriate, LM may repair or replace defective goods.

Alternatively, LM may issue a credit note for future purchases.

Any statutory rights of the customer remain unaffected where mandatory law provides otherwise.

3.5 Return Procedure

If LM requests the return of disputed goods, the customer shall return them at their own expense.

Returned goods must include:

  • Delivery or invoice number

  • Article number

  • Quantity

  • Reason for complaint

  • Confirmation that the goods were stored correctly

  • Date and signature

LM reserves the right to inspect returned goods before determining the appropriate remedy.

 

4. Orders and Prices

4.1 Orders

Orders may be placed via the website, email, telephone, or in writing.

4.2 Prices

Invoices are issued according to the prices applicable at the time the order is accepted.

Prices published on the website or in catalogues are provided for information purposes and do not constitute legally binding offers.

Unless otherwise stated, all prices are inclusive of VAT.

Customers are responsible for any import duties, customs charges, or local taxes.


 

5. Payment

5.1 Payment Methods

Orders within Switzerland are payable by invoice using the supplied payment information.

International orders require advance payment by bank transfer or PayPal.

Any payment processing fees, where applicable, will be indicated during checkout.

5.2 Payment Terms

Invoices are payable within ten (10) days of the invoice date.

The customer may not withhold payment because of a complaint unless required by mandatory law.

5.3 Late Payment

Upon expiry of the payment period, the customer is deemed to be in default without further notice.

LM reserves the right to suspend or cancel outstanding deliveries until payment has been received.

5.4 Set-off

LM may offset any amounts owed by the customer against amounts payable by LM to the customer, where legally permissible.

5.5 Invoice Objections

Any objection to an invoice must be submitted in writing before the payment due date.

Undisputed portions of the invoice remain payable within the agreed payment period.

5.6 Advance Payment

LM reserves the right to require advance payment for certain orders.


 

6. Liability

6.1 Liability

LM shall be liable only for direct damages resulting from intentional or negligent breach of contract, subject to applicable mandatory law.

Liability for indirect, consequential, incidental, or purely financial losses, including loss of profit, is excluded to the extent permitted by law.

Nothing in these GTC excludes liability where such exclusion is prohibited by applicable law.

6.2 Transfer of Risk

Unless otherwise required by mandatory law, the risk of loss passes to the customer upon delivery of the goods.


 

7. Data Protection

7.1 Processing of Personal Data

LM processes personal data solely for the purposes of processing orders, managing customer relationships, providing customer support, fulfilling legal obligations, and improving its services.

Personal data is processed in accordance with applicable Swiss data protection legislation.

7.2 Disclosure to Third Parties

Personal data may be shared with service providers where necessary to fulfil contractual obligations, including payment providers and shipping companies.

LM will not disclose customer data to other third parties unless required by law or with the customer's consent.

8. Amendments

LM reserves the right to amend these GTC at any time.

The version published on the website at the time an order is placed shall apply to that order.

The online version is the authoritative version.

 

9. Governing Law and Jurisdiction

These GTC and all contracts between LM and the customer are governed exclusively by Swiss law, excluding conflict-of-law rules.

To the extent permitted by applicable law, the exclusive place of jurisdiction shall be the registered place of business of LM.

Mandatory statutory places of jurisdiction for consumers remain unaffected.
